The neighbor argues that he was exercising his First Amendment right to free speech and that his comments were based on factual incidents involving the dog's behavior. He also claims that the dog owner has a history of being aggressive and confrontational.
The judges must determine if the neighbor's comments were defamatory and if they caused harm to the dog owner and his family. They must also consider if the neighbor's comments were protected under his right to free speech.
